Finalizing Your Divorce

Document Preparation & Filing

This page provides a breakdown of the process for finalizing your divorce or custody case. Please note that additional or different steps may be required depending on the specifics of your case.  

Step 1. Reach an Agreement

• Reach a full agreement
- This is acheived through the mediation process
• Write and sign the agreement
- Your mediator will write up the agreement, called an "MOU",  and send it to you to review and sign
- You have the option of having your own, independent attorney review the agreement before signing

Step 2. Submit Payment

• Submit payment
- If you have children, the flat-fee cost is $750 + $358 for the mandtory Court Filing Fee ($1,108 total)
- If you do not have children, the flat-fee cost is $500 + $358 for the mandtory Court Filing Fee ($858 total)
- A team member will email you the payment link

Step 3. Complete Required Forms

• If you don't have children, complete the following forms:
- Certificate of Divorce Form (one party only)
• If you do have children, complete the following forms:
- Vital Stat Form (one party only)
• If you do have children, you must also provide one of the following:
- Three recent pay stubs, OR
- Your two most recent tax returns, OR
- Your most recent W2, OR
- A profit and loss statement from your business

Step 4. Initial Filing

• Your mediator or paralegal will prepare and submit the following documents to the Courts:
- Your Petition for Divorce (required)
- Your Agreement, or "MOU"
- Your Child Support Worksheet
- All of the required documents described above
• Domestic Relations Injunction
- The Courts will automatically issue a Domestic Relations Injunction

Step 5. 30-Day Waiting Period

• After submitting the Initial Filings, the 30-day waiting period begins
- The 30-day waiting period is mandated by Utah law
- Exceptions may apply in cases of abuse or exigent circumstances
• During the 30-day waiting period, you can complete the following:
- Divorce Orientation Class (if you are married and have minor children)
- Parent Education Class (if you are unmarried and have minor children)

Step 6. Submitting Final Documents

• After the 30-day waiting period ends, we submit the following to the Courts:
- Stipulation
- Affidavit of Jurisdiction & Grounds for Divorce
- Fact and Conclusions of Law
- Decree of Divorce
• Approval and Notice
- The Courts generally take 1-14 days to approve the documents (though it can be longer)
- We will notify you as soon as the courts have approved the documents
- Once they are approved, your divorce will be complete
